PLEASE READ THESE TERMS AND CONDITIONS CAREFULLY

A condition of entry is that CUSTOMERS ASSUME ALL RISK OF PERSONAL INJURY. Participating in water related attractions are participatory activities and hence involve inherent risks

All customers AGREE and COMPLY with the WaterWorks Park staff directions, instruction signs, rules and regulations not limited to the contents of this specific agreement and further understand that these rules and regulations may be modified of changed at any time. It is essential that each guest, regularly familiarize themselves with current rules, regulations and policies. Safety is a shared responsibility, and minor children should have proper supervision from an adult or supervising companion.

Guests must use care as paved surfaces, slides, slide decks and other common areas may be wet. No running is allowed. Pregnant women, persons with heart conditions or high blood pressure, or recent surgeries are prohibited from using slides. Person with casts that extend above the elbow are prohibited from riding slides. Further, guests are in the best position to evaluate their own physical abilities and limitations, and whether or not to participate.

NON or WEAK SWIMMERS must wear a United States Coast Guard (USCG) approved personal flotation device while on rides, in pools or the wave pool.

Due to the nature of the Raging River and Avalanche (inner tube slides) guests must be of a size and strength to carry their own tube to the launch area to ride alone.

Children must be 42” tall and be of size and strength to carry their own tube to the launch area to ride the Cyclone alone.

Children must be 48” tall to ride the flume waterslides.

Children under 48” tall must wear a United States Coast Guard (USCG) approved floatation device and be accompanied by and adult in the wave pool and within the wave pool parameters.

Lap riding is not permitted on any rides.

COMPANY RIGHTS

We may photograph, film, videotape, record or otherwise reproduce the images and/or voice of any person who enters WaterWorks Park and use the same for any purpose without payment to any person.

We reserve the right to deny admission, or to require a person already admitted to leave the Park, without refund, liability or compensation if we consider that the circumstances so require.

We reserve the right to inspect bags, packages, and cabanas/daybeds when a violation of Park Rules is suspected.

We may change from time to time, without prior notice and without refund or compensation, change the operating hours of the Park or attraction, close the Park or any part of it temporarily, restrict the number of persons having access to the Park, and/or suspend or cancel any attraction or entertainment program if we consider that the circumstances so require.

PURCHASES

Admission tickets are only usable/valid within the season they are purchased. Refunds for unused purchased tickets must be refunded before the end of the operating season in the year in which they were purchased and must be accompanied by a valid receipt.

Season Passes are only valid for the season in which they are purchased. Season Passes are “activated” by the office issuing a season pass card with a person’s name and/or picture on it. Activated Season Passes may not be transferred to another person and will not be refunded.

Season Passes which have not been activated may be carried over to the following year if arranged with the office before the end of the operating season in which they were purchased.

Season passes will not be refunded or prorated for inclement weather. Unfortunately, disasters do happen and we will do all we can to get the park back up and running as soon as possible.

Complementary tickets given with a Season Pass purchase are valid only for the season they were issued. They are meant for family or friends of the Season Pass purchaser. They may not be resold and hold no cash value. Tickets that are lost, stolen or misplaced will not be reissued. Tickets found for sale, will be deactivated and void their use.

Complementary tickets, free tickets, gift tickets and or any tickets that were not purchased are only valid for the season in which they were issued. They may not be resold and hold no cash value. SPLASH CASH AND SEASON PASS BUNDLES

Season Pass Bundles are only available to current season pass holders. All bundles must be purchased in the office before use. Portions of unused bundles will not be refunded at the end of the operating season. Bundles cannot be split between multiple season pass cards. One tube per day may be used from a Tube Bundle. Multiple meals or lockers may be used from a Locker or Meal Bundle within one day.

LOST, STOLEN OR MISPLACED SEASON PASSES

It is the responsibility of the owner to safeguard their Season Pass. It is the responsibility of the Season Pass holder to notify the office if your Season Pass is lost, stolen or misplaced.

Splash Cash, tubes, meals, and lockers applied to a Season Pass will not be reissued if the Season Pass is used without authorization of the Season Pass holder.

PROHIBITED FROM ENTERING THE PARK

  • Outside food or drinks (including cans, soft‑plastic water bottles), ice chests, coolers, picnic lunches, etc. A shaded picnic area is available outside the park.

  • Alcohol, marijuana, or any illegal substances.

  • Snorkels, fins, mono‑fins, pool toys/noodles, or non‑USCG‑approved flotation devices.

  • Shade umbrellas or tents.

  • Clothing or visible tattoos with explicit language, nudity, or other offensive imagery or gestures.

  • Non-modest swim wear.

  • Patron Drones or other unmanned aerial devices.

  • Confetti, Glitter, Latex balloons

  • Glass

PHOTOGRAPHY, FILMING & SOCIAL MEDIA TERMS AND CONDITIONS OF ADMISSION

Conditions of Entry

By purchasing a ticket, accepting complimentary admission, entering the property, participating in any event, or otherwise accessing the premises of the Waterpark ("Park"), every guest, visitor, employee, contractor, vendor, performer, media representative, and any other person entering the Park ("Visitor") agrees to these Terms and Conditions.

1. Personal Photography

Visitors may take photographs and videos for personal, non-commercial use only.

Personal photography must not:

  • Interfere with Park operations.

  • Obstruct attractions, walkways, or guest traffic.

  • Create safety hazards.

  • Harass or invade the privacy of other guests or employees.

  • Violate any Park rule or staff instruction.

2. Commercial Photography, Filming & Content Creation Prohibited

No person may photograph, film, record, livestream, broadcast, or otherwise create content on Park property for any commercial, promotional, professional, business, advertising, marketing, sponsorship, publicity, media, or influencer purpose without the Park's prior written authorization.

This prohibition applies regardless of whether the individual receives compensation or other consideration.

Prohibited commercial activities include, but are not limited to:

  • Social media influencing

  • Sponsored content

  • Brand partnerships

  • Product promotions

  • Professional photography

  • Professional videography

  • YouTube productions

  • TikTok content

  • Instagram or Facebook promotional content

  • Livestreams

  • Commercial reels or short-form videos

  • Advertising campaigns

  • News or media productions

  • Business marketing

  • Portfolio shoots

  • Content created on behalf of another person or business

3. Approval Required

Any commercial filming or photography requires prior written approval from Park Management.

Approval may be granted, denied, conditioned, suspended, or revoked at the sole discretion of the Park.

4. Content Approval

Any person granted permission to create commercial or promotional content agrees that:

  • All photographs, videos, recordings, captions, edits, graphics, thumbnails, hashtags, descriptions, and related materials are subject to Park review.

  • No content may be published, uploaded, broadcast, distributed, or otherwise released until final written approval has been provided by Park Management.

  • The Park may require revisions, edits, additional disclosures, delayed publication, or may deny publication altogether.

Permission to film does not constitute permission to publish.

5. Intellectual Property

The Park's name, logos, trademarks, attractions, branding, trade dress, signage, characters, artwork, proprietary features, and other intellectual property may not be used for commercial purposes without prior written authorization.

6. Right to Enforce

The Park is private property.

The Park reserves the right, at its sole discretion, to:

  • Restrict or prohibit photography or filming.

  • Stop any recording activity.

  • Revoke previously granted permission.

  • Require unauthorized commercial activity to cease immediately.

  • Request removal of unauthorized published content or request deletion of unauthorized recordings where permitted by applicable law.

  • Remove any Visitor from the premises without refund.

  • Revoke admission, memberships, or season passes.

  • Refuse future admission.

  • Pursue any legal or equitable remedies available under applicable law.

7. Employees, Contractors & Vendors

Employees, contractors, vendors, performers, concessionaires, volunteers, and other individuals working on Park property may not create, publish, or distribute photographs, videos, or social media content depicting the Park, its guests, operations, attractions, facilities, or behind-the-scenes areas without prior written authorization from Park Management.

This restriction applies regardless of whether the content is created during working hours or personal time while on Park property.

8. Assumption of Risk

Visitors acknowledge that photography and videography for Park operational, security, promotional, or documentation purposes may occur throughout the premises.

By entering the Park, Visitors consent to being incidentally photographed or recorded by the Park or its authorized representatives without compensation, except where prohibited by law.

9. Violation of These Terms

Violation of these Terms may result in:

  • Immediate removal from the Park without refund.

  • Revocation of admission privileges.

  • Revocation of season passes or memberships.

  • Removal from future events.

  • Termination of employment or contractual relationships, where applicable.

  • Legal action, including claims for injunctive relief, damages, attorneys' fees where authorized by law, and any other remedies available under applicable law.

10. Acceptance

Entry onto Park property constitutes acceptance of these Terms and Conditions. Any Visitor who does not agree to these Terms must not enter the premises. 

11. Content Integrity, Accuracy & Representation

As a condition of any approval to photograph, film, record, livestream, or otherwise create commercial or promotional content on Park property, the content creator agrees that:

  • All published content must accurately represent the Park, its facilities, attractions, employees, and operations.

  • Content may not be deceptively edited, manipulated, or presented in a manner that creates a false or misleading impression of the Park, its services, or its safety.

  • Content may not falsely imply that the Park endorses, sponsors, affiliates with, or approves any individual, company, product, service, or organization unless the Park has provided prior written authorization.

  • Content may not use the Park's name, logos, trademarks, branding, trade dress, or other intellectual property except as expressly authorized in writing.

  • Any sponsored, paid, or compensated content must comply with all applicable laws and advertising disclosure requirements.

  • Park Management reserves the right to require corrections, edits, disclaimers, delayed publication, or to revoke approval if published content materially differs from the version approved by the Park or otherwise violates these Terms and Conditions.

Nothing in this section is intended to prohibit truthful statements, lawful reviews, or opinions. However, any individual who has been granted permission to create commercial or promotional content on Park property must comply with the approval process and all conditions of that approval as a condition of continued access to the Park.

 

12. Injunctive Relief. The Visitor acknowledges that unauthorized commercial photography, videography, recording, publication, or use of the Park's name, trademarks, branding, proprietary information, or other protected interests may cause immediate and irreparable harm for which monetary damages alone may be inadequate. The Park reserves the right to seek temporary, preliminary, and permanent injunctive relief, in addition to any other legal or equitable remedies available under applicable law, to prevent or stop violations of these Terms and Conditions.

PHOTOGRAPHY, VIDEO RECORDING & SOCIAL MEDIA POLICY

Photography & Personal Use

We welcome our guests to capture memories during their visit. Guests may take photographs and videos for personal, non-commercial use only, provided they do not interfere with the enjoyment, privacy, or safety of other guests or park operations.

Personal photography and video may include:

  • Family and vacation photos.

  • Personal videos for private viewing.

  • Non-commercial sharing with family and friends.

Guests must always comply with park rules, staff instructions, and all applicable laws while taking photographs or videos.

 

Commercial Photography, Filming & Content Creation

All commercial photography, videography, filming, recording, livestreaming, influencer content, brand promotions, sponsorships, advertising, media production, professional productions, monetized content, or content created for business purposes is strictly prohibited unless expressly authorized in writing by Park Management before entering the property.

This prohibition includes, but is not limited to:

  • Influencers

  • Content creators

  • Bloggers

  • Vloggers

  • YouTubers

  • Streamers

  • TikTok creators

  • Instagram creators

  • Facebook creators

  • Professional photographers

  • Commercial videographers

  • News media

  • Marketing agencies

  • Brands

  • Vendors

  • Contractors

  • Employees

  • Paid guests

  • Complimentary guests

  • Season pass holders

  • Event participants

  • Any individual or organization entering park property

Whether compensation is received directly or indirectly is irrelevant. This policy applies to both paid and unpaid commercial activity.

Commercial use includes any content intended to:

  • Generate revenue.

  • Promote a business, product, service, or individual.

  • Increase social media engagement or audience growth.

  • Support sponsorships or partnerships.

  • Advertise or market any product or service.

  • Be used in professional portfolios or commercial publications.

  • Be distributed for promotional purposes.

 

Management Approval Required

Any individual or organization seeking to film, photograph, record, livestream, or create content for commercial or promotional purposes must receive prior written approval from Park Management.

Approval may require:

  • Submission of a filming request.

  • Description of proposed content.

  • Identification of all participants.

  • Dates and times requested.

  • Insurance documentation, if applicable.

  • Execution of a filming agreement.

  • Compliance with all park operational and safety requirements.

Approval may be granted or denied at the sole discretion of Management.

 

Content Review & Posting Approval

As a condition of any approved commercial filming or photography:

  • Park Management reserves the right to review all photographs, videos, recordings, edits, captions, hashtags, thumbnails, and related content before publication.

  • No approved content may be published, posted, uploaded, broadcast, distributed, or otherwise shared without final written approval from Park Management.

  • Management may require edits, revisions, removal of content, or decline permission for publication for any reason.

Failure to obtain final approval before posting constitutes a violation of this policy.

 

Private Property

This waterpark is privately owned property.

Entry onto park property constitutes acknowledgment and acceptance of this policy.

Management reserves the right to:

  • Restrict or prohibit photography or filming at any time.

  • Revoke filming permission at its sole discretion.

  • Require cessation of photography or recording.

  • Request deletion of unauthorized commercial content captured on the premises, where permitted by law.

  • Remove any person violating this policy from the property without refund.

  • Suspend or revoke tickets, memberships, season passes, or privileges.

  • Pursue any legal or equitable remedies available under applicable law.

 

Privacy & Guest Experience

Guests, employees, and contractors must respect the privacy, comfort, and safety of others.

Photography or recording that:

  • Harasses others,

  • Invades reasonable expectations of privacy,

  • Interferes with park operations,

  • Creates safety hazards,

  • Blocks walkways or attractions,

  • Uses drones or unauthorized equipment,

  • Uses lighting, tripods, stabilizers, or professional production equipment without authorization,

is prohibited.

 

Employees, Contractors & Vendors

Employees, contractors, vendors, performers, and all persons conducting business on park property may not create, publish, or distribute photographs, videos, or social media content depicting the park, its operations, employees, guests, attractions, facilities, or proprietary information without prior written authorization from Park Management.

This restriction applies regardless of whether such content is created during working hours or personal time while on park property.

 

Enforcement

Failure to comply with this policy may result in one or more of the following:

  • Immediate removal from the premises.

  • Revocation of filming privileges.

  • Revocation of admission or season pass privileges.

  • Removal from future events.

  • Termination of employment or contractual relationship (where applicable).

  • Legal action to protect the park's property, intellectual property, business interests, and guest experience.

Contact

Requests for commercial photography, filming, media access, or influencer collaborations must be submitted to Park Management for review and written approval before arrival.

WAIVER AND RELEASE AND AGREEMENT TO TERMS AND CONDITIONS: BY COMPLETING THE TICKET PURCHASE AND ENTERING THE WATER PARK, IS DEEMED AN ACCEPTANCE OF THE TERMS AND CONDITIONS ABOVE. ALSO, BY DOING SO, I AGREE FOR MYSELF AND ANY MINORS ON WHOSE BEHALF I PURCHASED TICKETS FOR, THAT WATER WORKS PARK AND ITS OFFICERS, DIRECTORS, MEMBERS, AGENTS AND EMPLOYEES (“RELEASED PARTIES”) WILL NOT BE LIABLE FOR ANY INJURY SUSTAINED IN THE WATER PARK, NO MATTER HOW IT OCCURS. I ALSO AGREE FOR MYSELF AND ANY MINORS ON WHOSE BEHALF I PURCHASED TICKETS FOR, TO WAIVE ANY AND ALL CLAIMS FOR PERSONAL INJURY AND/OR DEATH AGAINST RELEASED PARTIES, AND SUCH WAIVER AND RELEASE INCLUDES ANY AND ALL NEGLIGENCE OF RELEASED PARTIES, WHETHER THE SAME OCCURS FROM PARTICIPATING ON THE ATTRACTIONS, OR BEING PRESENT ON THE PROPERTY (INCLUDING PARKING LOT, BATHROOMS AND OTHER AREAS OF THE WATER PARK).
